These Terms and Conditions ("Terms") govern your access to and use of the NutriKids website, account features, menu information, ordering tools, cart, checkout process, message forms, and related services (collectively, the "Services"). By using the Services, creating an account, submitting an order request, or communicating with NutriKids, you agree to these Terms.
If you use the Services on behalf of a school, daycare, campus, organization, parent, guardian, or child, you confirm that you are authorized to do so and to provide the information submitted through the Services.
1. NutriKids Services
NutriKids provides meal planning, menu coordination, parent ordering, school and daycare delivery coordination, and related support services. Meals may be prepared through approved commercial kitchens selected based on the campus or school being served, proximity to the kitchen, menu requirements, delivery timing, operational availability, and culturally varied menu needs, including flavours inspired by Chinese, Persian, Indian, and other food traditions where available.
NutriKids may modify menus, delivery options, available campuses, serving days, prices, order windows, minimum order requirements, and service availability at any time.
2. Account Access
The Services may provide different account access types, including parent, school administrator, and daycare operator access. You are responsible for providing accurate account information, keeping your login credentials secure, and notifying NutriKids if you believe your account has been accessed without authorization.
NutriKids may suspend, restrict, or close an account if we reasonably believe the account is being misused, contains inaccurate information, creates safety or delivery concerns, violates these Terms, or is otherwise harmful to NutriKids, a school, daycare, child, parent, or service provider.
3. Parent and Guardian Responsibility
Parents and guardians are responsible for ensuring that all child, campus, delivery, allergy, dietary, and order information submitted through NutriKids is accurate and current. This includes the child's name, selected school or daycare, delivery days, menu choices, allergies, special diet notes, and any other meal instructions.
Children should not create accounts, place orders, submit payment information, or communicate directly with NutriKids through the website.
4. Menus, Allergies, and Dietary Notes
Menu information may vary by school, daycare, campus, week, menu type, food availability, delivery schedule, kitchen assignment, special diet coordination, and cultural menu planning. NutriKids may include flavours inspired by Chinese, Persian, Indian, and other food traditions, and may substitute or modify items when ingredients, kitchen capacity, delivery timing, safety, availability, or other practical needs require it.
NutriKids uses allergy and dietary notes to help coordinate meal service, but NutriKids is not a medical provider. Parents, guardians, schools, and daycares must communicate serious allergies, restrictions, or medical needs directly and clearly. NutriKids may decline or cancel an order if we cannot reasonably support a dietary, allergy, safety, or delivery requirement.
5. Order Submission Is Not Order Confirmation
Placing an order, submitting a cart, or using the checkout screen does not mean that the order has been accepted, approved, confirmed, or scheduled for delivery. An order submitted through NutriKids is an order request only.
After an order request is submitted, NutriKids may review the order for campus eligibility, delivery route, kitchen availability, menu availability, cultural menu needs, allergy or dietary requirements, order timing, minimum days, minimum quantity, and other operational requirements.
An order will only be approved if NutriKids determines that the applicable minimum delivery days and minimum quantity criteria are met for the relevant campus, route, kitchen, menu period, or service arrangement. Minimum criteria may vary by school, daycare, location, route, meal type, menu period, or other operational needs.
If the order request is approved, NutriKids will send an email with approval details and instructions to pay by Interac e-Transfer. The order is not confirmed until NutriKids approves it and any required payment has been received, matched, and accepted by NutriKids. Once an order is accepted and payment is confirmed, cancellation is not permitted.
If the order request is not approved, NutriKids may decline the order, request changes, suggest an alternate schedule or quantity, or place the request on hold. NutriKids is not obligated to fulfill any order request that has not been approved and paid as required.
6. Payment by E-Transfer
Unless NutriKids states otherwise in writing, approved orders may require payment by Interac e-Transfer. Payment instructions will be provided by email after approval. You are responsible for following the payment instructions exactly, including any recipient, reference, security question, message, amount, or deadline instructions included in the approval email.
An e-Transfer sent before approval, sent for the wrong amount, sent without the required reference information, or sent after the stated deadline may delay or prevent order confirmation. NutriKids may reject, refund, or hold unmatched payments until the related order request can be identified and resolved.
7. Pricing, Taxes, and Availability
Prices, menu items, taxes, fees, delivery options, and available service periods may change without notice. Errors may occur in menu descriptions, prices, availability, or order details. NutriKids may correct errors, reject an order request, request updated approval, or revise an order before it is confirmed.
All orders are subject to availability, kitchen capacity, campus participation, delivery route feasibility, order window deadlines, minimum criteria, and payment completion.
8. Cancellations, Changes, and Refunds
Cancellation, change, credit, and refund requests are reviewed by NutriKids based on the status of the order, kitchen preparation timing, delivery planning, campus schedule, and whether ingredients or meals have already been purchased, prepared, packed, or delivered.
Once an order has been accepted and payment has been confirmed, cancellation is not permitted. NutriKids may also be unable to change, credit, or refund an order once preparation has started or delivery planning has been finalized. Refunds or credits, when provided, may be issued in the manner determined by NutriKids.
9. Delivery to Schools and Daycares
NutriKids delivery is coordinated with participating schools, daycares, campuses, commercial kitchens, and delivery routes. Delivery times are estimates and may be affected by weather, traffic, school closures, daycare schedules, emergency conditions, kitchen capacity, staffing, or other events beyond NutriKids' control.
NutriKids may decline or pause service to a campus or route if delivery cannot be performed safely, reliably, or in a manner consistent with food quality and operational requirements.
10. Communications
By creating an account, submitting an order request, or contacting NutriKids, you agree that NutriKids may send service-related communications about account access, order requests, approvals, e-Transfer instructions, payment status, delivery updates, menu changes, support messages, and policy updates. You are responsible for keeping your email address and other contact information current.
Marketing communications, if any, will be handled in accordance with applicable law and NutriKids' Privacy Policy.
11. Acceptable Use
You agree not to misuse the Services. You must not submit false information, interfere with website security, attempt unauthorized access, use another person's account, upload harmful code, scrape or copy the website in an abusive manner, or use the Services for unlawful, fraudulent, harmful, or disruptive purposes.
12. Intellectual Property
The NutriKids name, logo, website content, menu presentation, text, graphics, design, software, and related materials are owned by or licensed to NutriKids and are protected by applicable intellectual property laws. You may use the Services only for their intended purpose and may not copy, modify, distribute, or exploit NutriKids materials without permission.
13. Privacy
NutriKids handles personal information according to the NutriKids Privacy Policy. By using the Services, you acknowledge that NutriKids may collect, use, share, and retain information as described in the Privacy Policy, including information needed to process order requests, coordinate meals, support delivery, handle payments, and respond to inquiries.
14. No Guarantee and Limitation of Liability
NutriKids works to provide accurate menus, reliable delivery coordination, and quality service, but the Services are provided on an "as available" basis. To the fullest extent permitted by law, NutriKids is not liable for indirect, incidental, special, consequential, punitive, or similar damages, including losses related to delays, unavailable menu items, declined orders, website interruptions, inaccurate user information, third-party services, or events beyond our reasonable control.
Nothing in these Terms limits liability that cannot be limited under applicable law.
15. Changes to These Terms
NutriKids may update these Terms from time to time. Updated Terms will be posted on this page with a new "Last updated" date. Continued use of the Services after changes are posted means you accept the updated Terms going forward.
16. Governing Law
These Terms are governed by the laws of Ontario and the applicable laws of Canada, without regard to conflict of law principles. Any dispute will be handled in the courts or tribunals with jurisdiction in Ontario, unless applicable law requires otherwise.

Summary of the order process:
- Submitting an order creates a request only.
- NutriKids reviews the request against campus, route, kitchen, minimum days, and minimum quantity criteria.
- If approved, NutriKids emails e-Transfer payment instructions.
- The order is confirmed only after approval and required payment acceptance.
- Once accepted and payment confirmed, the order cannot be cancelled.
